Facts:

The husband was a member of the United States Navy. Following the parties’ separation, the wife moved to Florida with their child. On appeal, the wife contended that the statutory presumption of domicile for a member of the armed services in Va. Code Ann. § 20-97(1) was rebuttable. The appellate court found no error in the trial court’s assumption of jurisdiction since the evidence showed that the husband was a member of the armed services and had been stationed or resided in Virginia for a period of six months or more prior to the commencement of the instant action. Thus, the trial court had subject matter jurisdiction to adjudicate the divorce action. The wife also argued that the trial court lacked jurisdiction to rule on the child custody matter because the child had resided in Florida for more than six months before the bill of complaint was filed. The appellate court found that the child’s home state was Florida, and thus the Virginia Beach circuit court lacked jurisdiction to determine child custody in the instant action.
