Facts:

Defendant appealed his conviction for malicious wounding in the Circuit Court of Arlington County, contending that the trial court erred when it denied his motion to quash his indictment for malicious wounding. Defendant argued that the wounding provided the element of force necessary to sustain his conviction for robbery and that the Double Jeopardy Clause barred his subsequent prosecution for the same offense.

  • The crime of robbery includes the element of theft of property from the victim, an element not present in the crime of malicious wounding under Va. Code Ann. § 18.2-51. The crime of malicious wounding includes the element of wounding with the intent to maim, disfigure, disable or kill, an element not present in the crime of robbery. Robbery and malicious wounding, therefore, are not the “same offense,” since malicious wounding is not a lesser included offense of robbery.
