The Virginia Court made the following holding:
  • On appeal of a criminal conviction, the appellate court views the evidence in the light most favorable to the Commonwealth, the prevailing party at trial.
  • When an issue of statutory construction is involved, the statutory interpretation presents a pure question of law and is accordingly subject to de novo review by an appellate court. Therefore, the appellate court must determine the general assembly’s intent from the words contained in the statute.
  • The general rule of statutory construction is to infer the legislature’s intent from the plain meaning of the language used. Thus, an undefined term must be given its ordinary meaning, given the context in which it is used. Furthermore, the plain, obvious, and rational meaning of a statute is to be preferred over any curious, narrow, or strained construction, and a statute should never be construed in a way that leads to absurd results.
